Terms of Service

1. Agreement to Terms

By accessing or using Relasify ("Platform" or "Service"), operated by PT Kreasi Raya Nusantara ("Company", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Relasify is a comprehensive CRM platform that enables businesses to: • Customer Relationship Management: Manage contacts, leads, and customer interactions • WhatsApp Business Integration: Send and receive messages via WhatsApp Business API • Omnichannel Communication: Unified inbox for WhatsApp, email, and other channels • Helpdesk & Ticketing: Manage customer support tickets and inquiries • Call Center: Handle business calls with IVR and call routing • Analytics & Reporting: Track performance and generate insights The Service operates as a Technology Provider on the WhatsApp Business Platform in compliance with Meta's policies.

3. Eligibility

To use our Service, you must: • Be at least 18 years of age • Have the legal authority to enter into binding agreements • Have the authority to bind your organization (if applicable) • Have or be eligible for a WhatsApp Business Account • Comply with WhatsApp's Terms of Service and Business Policy • Not be prohibited from using the Service under applicable laws • Be a registered business entity (for business accounts)

4. Account Registration

4.1 Account Creation To use the Service, you must create an account by providing accurate, current, and complete information including: • Valid business email address • Business information and details • Contact information • Other required verification information 4.2 Account Security You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorized access • Ensuring authorized users comply with these Terms 4.3 Account Verification We may require verification of your business identity as part of WhatsApp Business Platform requirements, including business documentation and identity verification.

5. Acceptable Use Policy

5.1 Permitted Uses You may use the Service to: • Send legitimate business communications • Provide customer support and service • Send transactional notifications (orders, appointments, updates) • Conduct approved marketing with proper consent • Manage customer relationships 5.2 Prohibited Uses You agree NOT to: Messaging Violations: • Send spam or unsolicited bulk messages • Send messages without proper user consent (opt-in) • Exceed messaging frequency that constitutes harassment • Send misleading, deceptive, or fraudulent content • Impersonate other businesses or individuals Content Violations: • Transmit illegal, harmful, threatening, or offensive content • Share malware, viruses, or malicious code • Distribute adult content or gambling promotions (where prohibited) • Promote violence, discrimination, or hate speech • Violate intellectual property rights Technical Violations: • Attempt to circumvent rate limits or platform restrictions • Reverse engineer, decompile, or disassemble the Service • Use automated systems to abuse or overload the Service • Interfere with Service operation or security • Access accounts or data without authorization

6. WhatsApp Business Platform Compliance

6.1 Meta/WhatsApp Policies Your use of our Service is also subject to: • WhatsApp Business Policy • WhatsApp Commerce Policy • Meta Platform Terms • WhatsApp Business Terms of Service 6.2 Message Quality You must maintain acceptable message quality ratings as determined by WhatsApp. We may restrict or suspend accounts with: • Consistently low quality ratings • High block rates from recipients • Spam reports • Policy violations 6.3 Template Approval • Message templates must be approved by Meta before use • We are not responsible for template rejections by Meta • You must comply with template content guidelines • Rejected templates must be modified and resubmitted 6.4 Opt-In Requirements You must: • Obtain explicit opt-in consent before messaging users • Provide clear and easy opt-out mechanisms • Honor opt-out requests promptly (within 24 hours) • Maintain records of user consent

7. Google Services

7.1 Google Sign-In We offer Google Sign-In as an authentication option. By using Google Sign-In: • You authorize us to access your basic Google profile information • You agree to Google's Terms of Service and Privacy Policy • Authentication is processed through Google's secure OAuth 2.0 protocol 7.2 Google API Services Our use of Google API Services complies with the Google API Services User Data Policy, including the Limited Use requirements. 7.3 Your Responsibilities When using Google Sign-In, you are responsible for: • Maintaining the security of your Google account • Ensuring your Google account information is accurate • Notifying us if your Google account is compromised 7.4 Disconnecting Google You may disconnect your Google account at any time through: • Your Relasify account settings • Google's third-party app permissions at myaccount.google.com/permissions

8. Fees and Payment

7.1 Service Fees Fees for our Service are as described in your service agreement or our pricing page at relasify.com/pricing. 7.2 WhatsApp Conversation Fees WhatsApp conversation fees are: • Charged by Meta separately from our service fees • Based on conversation categories and volumes • Subject to Meta's pricing policies • Your responsibility to pay 7.3 Payment Terms • All fees are in Indonesian Rupiah (IDR) unless otherwise stated • Fees are due as specified in your agreement • Late payments may incur interest at 1.5% per month • Late payments may result in service suspension • All fees are non-refundable unless otherwise stated 7.4 Taxes All fees are exclusive of applicable taxes (including VAT/PPN). You are responsible for all applicable taxes.

9. Intellectual Property

8.1 Our Property The Service, including its software, design, user interface, documentation, trademarks, and logos, is owned by PT Kreasi Raya Nusantara and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service, not ownership. 8.2 Your Content You retain ownership of content you submit ("Your Content"). You grant us a license to use Your Content to: • Provide the Service • Improve our offerings • Comply with legal requirements 8.3 Feedback Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation to you.

10. Privacy

Your use of the Service is governed by our Privacy Policy at relasify.com/privacy-policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

11. Disclaimers

10.1 Service Provided "As Is" THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 10.2 No Guarantees We do not guarantee: • Uninterrupted or error-free service • Message delivery (dependent on WhatsApp/carrier infrastructure) • Template approval by Meta • Specific results from using the Service • Compatibility with all systems or devices 10.3 Third-Party Services We are not responsible for WhatsApp/Meta services, their policies, actions, or any third-party integrations.

12. Limitation of Liability

11.1 Exclusion of Damages TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR: • Indirect, incidental, special, or consequential damages • Lost profits, revenue, data, or business opportunities • Business interruption or loss of goodwill • Damages resulting from third-party actions or services 11.2 Liability Cap OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF: • Fees paid by you in the 12 months preceding the claim, or • IDR 10,000,000 (ten million Rupiah) 11.3 Exceptions These limitations do not apply to liability arising from our gross negligence, willful misconduct, or liability that cannot be limited under applicable Indonesian law.

13. Indemnification

You agree to indemnify, defend, and hold harmless PT Kreasi Raya Nusantara and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of WhatsApp/Meta policies • Your Content or messages sent through the Service • Your violation of third-party rights • Your violation of applicable laws or regulations

14. Termination

13.1 Termination by You You may terminate your account at any time by: • Contacting us at [email protected] • Using account deletion features in your settings 13.2 Termination by Us We may suspend or terminate your account: • For violation of these Terms • For violation of WhatsApp/Meta policies • For non-payment of fees • For suspected fraud, abuse, or illegal activity • At our discretion with 30 days notice 13.3 Effect of Termination Upon termination: • Your access to the Service will cease immediately • Your data may be deleted after 90 days • Accrued fees remain payable • Provisions that should survive termination will survive 13.4 Survival Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via: • Email to your registered address • Prominent notice on our platform • In-app notification Continued use of the Service after changes constitutes acceptance. If you disagree with changes, you must stop using the Service and close your account.

16. Governing Law and Dispute Resolution

15.1 Governing Law These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles. 15.2 Dispute Resolution Before filing a formal dispute, you agree to contact us at [email protected] to attempt informal resolution for at least 30 days. 15.3 Jurisdiction Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of South Jakarta, Indonesia. 15.4 Language These Terms are provided in English and Indonesian. In case of any discrepancy, the Indonesian version shall prevail for users in Indonesia.
